Ordinance No. 04-01
AN ORDINANCE REPEALING ORDINANCE NUMBER 92-1 REQUIRING A COUNTY LICENSE TO SELL, VEND, OR RETAIL GOODS , WARES AND MERCHANDISE WITHIN UNINCORPORATED GILPIN COUNTY.
WHEREAS, under C.R.S. §30-11-107(1)(i) and C.R.S. §12-51-101 et. seq., the Board of County Commissioners has the power, but not the obligation, to grant licenses to sell, vend and retail goods and merchandise within unincorporated portions of Gilpin County, and
WHEREAS, the Board of County Commissioners has determined that no purpose is served by such licensing requirement, such licensing requirement may discourage the creation of small businesses in the County and create needless administrative requirements, and that elimination of such licensing requirement will have no fiscal impact on the County, and
WHEREAS, continuation of the small business licensing requirement is not in the best interest of the public health, safety and welfare of the residents of the County of Gilpin.
NOW THEREFORE, be it ordained by the Board of County Commissioners of the County of Gilpin as follows:
1. Ordinance No. 92-1 is hereby repealed effective upon final adoption of this ordinance.
