Civil Process
Colorado State Law mandates that all sheriffs’
offices within the state must maintain a civil section. The civil
section is responsible for the service of all civil papers received
by the sheriff’s office. The Gilpin County Sheriff’s Office can only
serve civil papers within Gilpin County. If you have papers that
need to be served out of our jurisdiction, you will need to contact
the Sheriff’s Office or a private process server in that county. The
civil section also executes all court orders involving civil process
issued by the courts. Civil papers can be received at our office, or
can be mailed to the Gilpin County Sheriff's Office. A fee for service is required along with a fee for mileage. Fees are
set by statute and cannot be waived except by court order. All fees
are per person and not location. If there is more than one set of
papers going to the same address and can be served at the same time,
then only one mileage fee will be charged. Payment must be
received prior to service of papers.

Protective Orders
If you need to obtain a protection order you may contact the Gilpin
County Courts at 303-582-5522, located at 2960 Dory Hill Road in the
Justice Center, or Victim Services at 303-582-5926.

The state statutes are very specific on
the steps that need to be taken in order to evict a tenant.
The
eviction process involves 3 basic steps:
1.
Notice to
vacate or demand for compliance/possession
2.
Summons and complaint in unlawful detainer
3.
Writ of Restitution, service and execution
